These Terms of Service ("Terms") govern your access to and use of the Evental website at evental.co, our mobile applications, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Acceptance of Terms
By creating an account, purchasing an album, or otherwise using the Service, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. Description of Service
Evental is a QR code photo sharing platform designed for events such as weddings, birthdays, corporate gatherings, and other occasions. The Service allows you to create digital photo albums, generate a unique QR code for each album, and invite guests to scan the QR code to upload photos and videos directly to your shared album. All uploaded content is hosted securely and accessible to the album creator and authorised guests.
3. User Accounts
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to keep this information up to date. You must notify us immediately at support@evental.co if you suspect any unauthorised use of your account.
Guests who upload photos or videos via a QR code are not required to create an account. By scanning a QR code and uploading content, guests agree to these Terms.
4. Content Ownership
You and your guests retain full ownership of all photos, videos, and other content ("User Content") uploaded to the Service. Evental does not claim ownership of any User Content.
By uploading User Content to the Service, you grant Evental a limited, non-exclusive, royalty-free, worldwide licence to host, store, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service. This licence continues for as long as your content remains on the Service and terminates when your content is deleted.
You represent and warrant that you have the necessary rights to upload any content to the Service and that your content does not infringe on the intellectual property rights or privacy rights of any third party.
5. Payments and Refunds
Evental operates on a one-time payment model. There are no subscriptions or recurring fees. Our current pricing is as follows:
- Photo Album -- $25 (one-time payment)
- Photo & Video Album -- $35 (one-time payment)
All payments are processed securely through our third-party payment provider. Prices are listed in US dollars and may be subject to applicable taxes depending on your location.
We offer a full refund within 14 days of purchase, provided that no photos or videos have been uploaded to the album. Once content has been uploaded to an album, the album is considered used and is no longer eligible for a refund. To request a refund, please contact us at support@evental.co.
6. Privacy
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in our Privacy Policy.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Evental and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the Service.
Evental's total aggregate liability to you for all claims arising out of or relating to the Service shall not exceed the amount you paid to Evental in the twelve (12) months preceding the claim.
Evental does not guarantee that the Service will be uninterrupted, error-free, or free from harmful components. While we take reasonable measures to protect your content, we are not liable for any loss or corruption of uploaded photos or videos. We recommend that you maintain your own backups of any content you upload to the Service.
8. Termination
You may close your account and stop using the Service at any time by contacting us at support@evental.co.
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or uploaded content that is harmful, offensive, or infringes on the rights of others.
Upon termination, your right to use the Service will immediately cease. We may, at our discretion, delete your account data and uploaded content within a reasonable period following termination.
9. Changes to Terms
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will notify you by updating the "Last updated" date at the bottom of this page and, where appropriate, by sending you an email notification. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
